Terms and Conditions – Plaathoutgigant
Article 1: Applicability
These terms and conditions apply to every offer, quotation, and concluded agreement between Plaathoutgigant (hereinafter referred to as: 'Seller') and the buyer, both through the webshop and outside of it.
By placing an order, accepting a quote, or signing an order or delivery note, the buyer explicitly agrees to these terms and conditions.
Any purchasing or other terms and conditions of the buyer are explicitly rejected.
Article 2: Quotations and Prices
All quotations issued by Seller are non-binding and valid for 30 calendar days, unless stated otherwise in writing.
All prices listed on the website and in quotations include VAT, unless it is expressly stated that the prices exclude VAT.
Seller reserves the right to adjust agreed prices at any time if the cost price increases due to external factors. This includes, among other things, currency fluctuations, increases in material or raw material prices, increased transport costs, social charges, levies, or taxes.
Article 3: Payment and Retention of Title
Every order must be paid in full in advance via the webshop or at the latest upon collection of the goods.
All delivered goods remain the unconditional property of Seller until the buyer has fulfilled all payment obligations arising from the agreement. Until that time, the buyer is not permitted to process or dispose of the goods. Seller reserves the right to repossess unpaid goods without prior notice of default.
In the event of non-payment or incomplete payment by the invoice due date, the business buyer shall automatically and without prior notice of default owe late-payment interest of 10% per year. In addition, the outstanding amount will be increased by a fixed compensation fee of 10% of the total invoice amount, with an absolute minimum of 100 euros.
Article 4: Collection and Cancellation
Goods must be collected by the buyer at Seller's designated location. Transport by the buyer is entirely at their own risk and expense.
If ordered goods are not collected within 30 calendar days after the collection confirmation has been sent or the order confirmation has been signed, Seller has the right to consider the agreement cancelled. In that case, Seller may recover any incurred costs or lost profits from the buyer.
Article 5: Product Characteristics and Conformity
The buyer acknowledges that timber and sheet materials are natural products. Minor deviations in color, structure, similar characteristics, and the natural behavior of wood (such as minimal shrinkage, cracking, warping, or expansion) are inherent to the product. Seller is not liable for these variations.
Unless expressly agreed otherwise in writing, the goods conform to standard commercial quality. Deviations of up to a maximum of 10% regarding specified dimensions or weights are considered an acceptable tolerance within the industry and do not constitute grounds for non-conformity or complaints.
Article 6: Inspection, Warranty, and Liability
The buyer is obliged to thoroughly inspect the goods on site immediately upon collection for visible defects, damage, and quantities. By taking the goods without reservation, the buyer acknowledges that the external condition and quantity are in order.
Business customers can no longer make claims regarding visible defects or deficiencies after collection.
For consumers, the statutory warranty scheme for latent defects applies. If Seller is not the manufacturer of the delivered goods, Seller's liability for any manufacturing defects (including hidden manufacturing defects) is limited to the warranty provided by the relevant manufacturer, within the limits of mandatory law. Seller is never liable for indirect or consequential damages.
Article 7: Right of Withdrawal (Consumers for Online Purchases)
This article applies exclusively to individual consumers making a distance purchase via the webshop. Business customers (B2B) are fully excluded from the right of withdrawal.
The consumer has the right to withdraw from the online order without giving any reason within 14 calendar days from the physical acquisition of possession (collection).
To exercise the right of withdrawal, the goods must be returned in their original, undamaged, and unused condition. Because sheet material is a fragile product, the consumer is fully liable for any depreciation resulting from careless transport or improper storage after collection. If the returned panels are damaged, soiled, or processed, this reduction in value (which may be up to 100%) will be deducted from the refundable amount.
The right of withdrawal is legally excluded once goods have been cut to size, processed, or customized specifically at the customer's request.
Article 8: Applicable Law and Competent Court
All legal relationships between Seller and the buyer are governed exclusively by Belgian law.
Any disputes, controversies, or legal claims arising out of or related to these terms or the concluded agreements shall be submitted exclusively to the competent courts of the judicial district of Turnhout.
Article 9: Return Policy (Right of Withdrawal)
At Plaathoutgigant, we want you to know exactly where you stand. Because sheet material is a heavy, fragile, and specific natural product, we maintain a clear and transparent return policy that fully complies with our terms and conditions and the law.
Consumers (Individuals)
Are you purchasing as an individual consumer via our webshop? If so, you are legally entitled to a 14-calendar-day right of withdrawal.
-
Period: The cooling-off period starts on the day you physically collect the goods from us.
-
Conditions: The wood must be in its original, undamaged, and unused condition.
-
Damage & Depreciation: Because sheet material damages easily during transport or improper storage, you as a consumer are liable for any depreciation if the wood is returned damaged. This may mean we have to refuse the return or deduct the reduction in value (up to 100%) from the refund.
-
Costs: You are responsible for safely returning the goods to our collection location.
Business Customers (B2B)
The statutory right of withdrawal does not apply to business purchases. Orders placed by companies, sole proprietorships/freelancers, or under a business name cannot be returned or cancelled once the purchase is concluded or collected.
Important Exception: Customization
Has the customer (whether consumer or business) requested the sheet material to be specifically cut to size or processed? If so, the right of withdrawal is completely void. Custom-made products can never be cancelled or returned.
